
Ban the BannersFriday, 9 April 2010 Ban The Banners1st January 2010 the State Government brought in some legislation they called “Ban the Banners”. This was to stop developers using their covenants to stifle energy efficiency design.
If you want to look at the legislation the relevant part is Chapter 8A Part 2 (page 153) of the Qld Building Act.
Summary The developer cannot prohibit: 1. Roof colour if their colour is darker than Galvanised Steel or Zinc aluminium. 2. The energy efficient treatment of a window. 3. A person from moving into a house if the landscaping, fencing, driveway or similar work is not completed. 4. The installation of solar hot water or photovoltaic cells on any external surface. Or require 5. A minimum floor area 6. A minimum number of bedrooms or bathrooms 7. A construction time period 8. More than 1 garage. 9. A minimum pitch for the roof. 10. A certain orientation of the building on the site 11. External materials of finishes for the roof and wall
A few points to remember: 12. If the land contract was signed prior to 1st January 2010 this legislation has no affect. 13. This legislation also has no affect if the requirement is a Local Authority requirement.
